& Installation Terms
These
Terms and Conditions (these “Terms”) are for the protection of both you, our
Client (hereinafter referred to as “Client”, “you” or “your”), and The
Great Calling, LLC, owner of the “We Build Barn Doors” brand (hereinafter
referred to as “we”, “our”, or “us”). These
Terms and our quote for products and services form the entire agreement between
Client and us. As our valued Client, we want you to fully understand that you
have the right to accept or refuse all or part of our design, material and/or
build recommendations and/or receive another quote.
Client understands that upon the completion of the authorized work (i.e., on the day of product delivery and/or installation), Client will pay the total outstanding invoiced amount for our products and services immediately. If the outstanding balance is not paid within 24 hours of barn door delivery, pickup, or installation, Client will incur a $25/day late fee.
Client understands the minimum deposit that must be delivered to WEBUILDBARNDOORS.COM for a new barn door purchase is 30% of the total quoted price, which is non-refundable. Client recognizes that we commit significant resources to quoting, designing and obtaining parts and materials for each job, and that Client’s cancellation of an order will result in significant harm to us that may be difficult or impossible to calculate. Accordingly, any cancellation by Client (other than a cancellation arising from our material uncured breach of our obligations to you) will result in total forfeiture of the entire deposit unless notice of cancellation is given within 3 days of deposit AND the original purchase is also covered by a state “Three Day Right to Cancel” law (laws vary by state).
Client’s order will not become active and will not go into our build queue until Client’s deposit is paid. Once Client pays its deposit, the order goes into our build queue and will be built in the order in which it was received, unless Client has paid for expedited service, in which case the order will be bumped up to meet the agreed upon deadline.
Client understands and agrees that Client shall pay a $35.00 charge for all checks returned from the bank unpaid for any reason, in which case we will be entitled to demand and be paid in the form of a cashier’s check, cash, money order, or online payment. It is understood that in the event of default by Client of its payment obligations, Client will be responsible for any and all collection fees or court costs along with reasonable attorney’s fees. Should litigation or arbitration be required to settle any claim arising from this agreement, the prevailing party in any dispute shall be awarded all their reasonable attorney fees and costs. Costs shall include, without limitation, expert witness fees, fees paid to investigators, arbitration, and court costs.
Client understands that the warranties expressly described below only cover parts and products that fail during the applicable warranty period through normal use. Collisions, Acts of God, fire, water damage, negligence, intentional damage, or failure of maintenance and care for the barn door can result in damage that will not be covered by warranty.
Client understands that WEBUILDBARNDOORS.COM gives a 30-Day labor warranty on every installation, and that after 30 days if Client requests a service call to assess a problem with the door’s functionality Client will be charged our standard service call fee ($62.95). Our standard service call fee is subject to change without notice unless otherwise specified in writing.
Client understands the WEBUILDBARNDOORS.COM labor warranty is with the purchasing Client only, and any warranty is not automatically transferable unless stated otherwise in writing.
Client understands that WEBUILDBARNDOORS.COM is not responsible for any future damages to Client’s door that may result from not following the install technician’s recommendations, or from routine wear and tear.
WEBUILDBARNDOORS.COM’s doors are covered under warranty against defects for 6 months after installation/delivery; however, this warranty is not and should not be misconstrued as a “money back guarantee.” This warranty will apply only if Client’s barn doors exhibit signs of warping/separating during the 6-month warranty period, the barn doors have been used at all times under normal climate conditions (we are not responsible for warping/separating arising from use of barn doors in spaces that are not climate-controlled, whether because of power outage, lack of air conditioning or otherwise), and Client notifies us of the door’s condition immediately upon discovery thereof prior to expiration of the 6-month warranty period; in which case we will arrange for remediation to be performed free of charge as our sole obligation and your sole remedy for failure of such warranty. Client must notify us of an allegedly defective door’s condition within the 6-month warranty period, or a service fee may be assessed for any service calls.
Client acknowledges and consents to a mandatory minimum service fee of $62.95 being charged by WEBUILDBARNDOORS.COM for all service calls to re-align, adjust, or otherwise service doors that fall outside the 30-day installation warranty period or 6-month product warranty period.
Client fully understands the explanation of work received/recommended and assumes the responsibility to pay the invoice in full at the completion of work. Client also understands that Client’s door may cease to function properly if Client fails to heed the advice of the installation technician, or if Client fails to operate Client’s doors gently and normally going forward.
Client understands and acknowledges that a barn door installation is a semi-permanent application. A header board may be used to further support the barn door rail, and both the header board and rail will be screwed/bolted into the wall. Floor guides may also be installed to both the floor and baseboard, and drilling into these areas may occur for this purpose. Door handles will be attached to the doors and are often screwed/bolted through the door making them permanent and a semi-irreversible decision.
Client
understands and acknowledges that doors are NOT built by machines in a factory,
but rather are built by hand with real wood, and while every effort is made to
utilize only the best, blemish-free boards, various natural defects may be
present, including but not limited to knots, dark streaks, wood grain
variations, worm holes, cracks, checks, shakes, splits, wanes, and color variations.
SELF INSTALLATION
If Client chooses to install our barn doors themselves or has another person/company install our doors, Client agrees to hold Us harmless for any issues arising during installation or for the installation itself. Once Client takes possession of the door, all warranties are voided and we are no longer responsible for the door or its' proper installation.
By paying Client’s deposit, Client agrees and acknowledges that Client has read, understands, and agrees to the terms and conditions of WEBUILDBARNDOORS.COM’s services as set forth herein.
And now for some important legal disclaimers (required by law to be in all caps):
EXCEPT FOR THE LIMITED WARRANTIES DESCRIBED ABOVE, WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES, NOR DO WE WARRANT THE MERCHANTABILITY OF OUR PRODUCTS OR THAT OUR PRODUCTS ARE FIT FOR A PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED.
WE WILL NOT BE LIABLE TO CLIENT FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES
OR LOSS UNDER ANY CIRCUMSTANCES, REGARDLESS OF CAUSE AND REGARDLESS OF THE
THEORY OF LIABILITY ASSERTED BY CLIENT, WHETHER CONTRACT, TORT OR OTHERWISE.
